During his legal practice, Kempton frequently opposed government decisions and bureaucratic actions that he viewed as eroding property rights, including representing a grazing family in a prolonged battle against the termination of their lease under a Labor-Greens agreement to create national parks. Kempton had established strong ties to the Cook electorate long before his political candidacy. He first arrived in Cape York as a tourist in 1985, settled in Cooktown after his car broke down there, and became a local resident. In 1988, he opened the first law practice in Cooktown since 1935, later purchasing a small farm on the Endeavour River where he raised his family, and in the late 1990s he part-owned and managed a cattle station in the region.
